RELEASE, ASSUMPTION OF RISK, INDEMNIFICATION AND HOLD HARMLESS AGREEMENT

ACKNOWLEDGMENT AND ASSUMPTION OF RISK

I understand that there are inherent risks and dangers associated with participation in martial arts, combat sports, fitness training, and related activities conducted by or associated with Junkyard Fitness & Fighting Arts.

These activities include, but are not limited to, mixed martial arts (MMA), boxing, kickboxing, Muay Thai, wrestling, grappling, strength and conditioning, fitness training, self-defense training, sparring, drilling, competitions, seminars, open gym activities, and the use of training, exercise, martial arts, and fitness equipment.

I understand that these activities may involve, but are not limited to, punching, kicking, striking, blocking, clinching, wrestling, grappling, takedowns, throws, falling, rolling, joint locks, chokes, stretching, twisting, lifting, jumping, running, conditioning exercises, physical contact with other participants, and use of various training and exercise equipment.

I understand that participation in these activities can result in injury. Potential risks include, but are not limited to, bruises, cuts, sprains, strains, fractures, dislocations, concussions, head and spinal injuries, emotional pain and suffering, property damage, economic loss, permanent disability, paralysis, and death.

Knowing these risks, I voluntarily choose to participate in some or all of these activities and knowingly and voluntarily assume the risks associated with my participation.

RELEASE AND HOLD HARMLESS

In consideration for being permitted to participate in activities conducted by or associated with Junkyard Fitness & Fighting Arts, I voluntarily release, discharge, and agree to hold harmless Junkyard Fitness & Fighting Arts and its owners, officers, directors, coaches, instructors, employees, agents, independent contractors, volunteers, members, affiliates, representatives, successors, and assigns from any and all claims, demands, causes of action, damages, liabilities, costs, or expenses arising from or related to my participation in such activities, to the fullest extent permitted by law.

This release applies to claims arising from participation in classes, training, sparring, drilling, strength and conditioning, open gym activities, seminars, competitions, events, and other activities conducted by or associated with Junkyard Fitness & Fighting Arts.

This release also applies while I am waiting to participate, observing activities, using equipment, entering or leaving the facility, or otherwise present on the premises before, during, or after training or other activities.

I understand and agree that this release includes claims arising from the ordinary negligence of Junkyard Fitness & Fighting Arts or its owners, coaches, instructors, employees, agents, independent contractors, volunteers, members, or affiliates, including but not limited to ordinary negligence in instruction, supervision, activities of other participants, use or operation of equipment, and premises conditions, to the fullest extent permitted by applicable law.

INDEMNIFICATION

To the fullest extent permitted by law, I agree to indemnify and hold harmless Junkyard Fitness & Fighting Arts and its owners, officers, directors, coaches, instructors, employees, agents, independent contractors, volunteers, members, affiliates, representatives, successors, and assigns from claims, liabilities, costs, and expenses, including reasonable attorney fees, arising from or related to my participation in activities conducted by or associated with Junkyard Fitness & Fighting Arts.

PARTICIPATION ON AND OFF PREMISES

I understand that this agreement applies to activities conducted at Junkyard Fitness & Fighting Arts as well as Junkyard-sponsored, coached, organized, or related activities conducted at other locations, including seminars, competitions, tournaments, training sessions, and events.

I understand that participation in competitions, tournaments, seminars, and other off-site activities may involve additional risks and may require additional waivers or agreements from event organizers, sanctioning bodies, facilities, or other organizations.

MINOR PARTICIPANTS

If the participant is a minor, I certify that I am the participant's parent or legal guardian or am otherwise legally authorized to execute this agreement on the minor's behalf.

I understand the nature and risks of the activities described in this agreement and voluntarily consent to the minor's participation.

To the fullest extent permitted by applicable law, I agree on behalf of myself and the minor participant to the releases, assumption of risk, indemnification, and other terms contained in this agreement.

ACKNOWLEDGMENT

I acknowledge that I have had the opportunity to read this agreement in its entirety before signing it.

I understand the words and language contained in this agreement, understand the nature of the activities involved, understand the risks I am assuming, and understand that by signing this agreement I am giving up certain legal rights.

I voluntarily agree to the terms of this agreement.
